Terms and conditions for using our circuit training services

Welcome to Truexyseries. These Terms of Service ("Terms") govern your use of our circuit training services, facilities, and website. By accessing or using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By registering for our services, visiting our facilities, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.
Age Requirements
You must be at least 16 years of age to use our services independently. Participants under 18 require parental or guardian consent and supervision as required by New Zealand law.
2. Our Services
Circuit Training Programs
Truexyseries provides circuit training services including:
- High-intensity interval training (HIIT)
- Strength and conditioning circuits
- Cardiovascular endurance training
- Functional movement training
- Group classes and personal training sessions
Facility Access
Our facilities include exercise equipment, training areas, and amenities. Access is subject to:
- Current membership status
- Operating hours and schedules
- Facility maintenance and closures
- Compliance with safety protocols
Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with reasonable notice when possible.
3. Membership and Payment Terms
Membership Types
We offer various membership options with different terms, benefits, and pricing. Specific details are provided at the time of registration.
Payment and Billing
- Membership fees are due in advance according to your chosen payment schedule
- Payment methods include credit card, debit card, and bank transfer
- Late payment may result in suspension of services
- All fees are in New Zealand Dollars (NZD) and include applicable taxes
Cancellation and Refunds
- Membership cancellations require 14 days written notice
- Refunds are provided in accordance with New Zealand consumer protection laws
- Unused portions of prepaid memberships may be refunded at our discretion
- No refunds for services already rendered
Membership Transfers
Memberships are personal and non-transferable unless specifically authorized by management.
4. User Conduct and Facility Rules
Expected Behavior
All users must:
- Treat staff and other members with respect and courtesy
- Follow all posted facility rules and safety guidelines
- Use equipment properly and safely
- Maintain appropriate hygiene and attire
- Clean equipment after use
Prohibited Activities
The following are strictly prohibited:
- Harassment, discrimination, or intimidation of any kind
- Use of facilities while under the influence of alcohol or drugs
- Bringing unauthorized guests or allowing others to use your membership
- Recording or photographing others without explicit consent
- Smoking or vaping anywhere on the premises
- Bringing weapons or dangerous items
Dress Code
Appropriate athletic attire and closed-toe shoes are required. We reserve the right to refuse service to anyone not dressed appropriately.
5. Health and Safety
Health Screening
Before beginning any exercise program, you may be required to complete a health screening questionnaire. You must disclose any relevant health conditions or limitations.
Medical Clearance
We strongly recommend consulting with a healthcare provider before starting any new exercise program, especially if you have:
- Pre-existing health conditions
- Previous injuries or physical limitations
- Concerns about your fitness level
- Any condition that may affect your ability to exercise safely
Emergency Procedures
In case of emergency, our staff will follow established protocols. By using our services, you consent to necessary emergency response actions.
6. Liability and Assumption of Risk
Assumption of Risk
You acknowledge that physical exercise involves inherent risks, including but not limited to:
- Muscle strains, sprains, and other injuries
- Cardiovascular stress
- Equipment-related injuries
- Interactions with other participants
By participating in our programs, you voluntarily assume these risks and agree that you participate at your own risk.
Limitation of Liability
To the maximum extent permitted by New Zealand law, Truexyseries, its owners, employees, and agents shall not be liable for:
- Personal injuries sustained while using our facilities or services
- Loss or damage to personal property
- Indirect, consequential, or punitive damages
- Any damages arising from your failure to follow instructions or safety guidelines
Insurance
We maintain appropriate insurance coverage. However, we strongly recommend that you maintain your own personal health and accident insurance.
7. Intellectual Property
All content on our website and in our programs, including but not limited to text, graphics, logos, images, and software, is the property of Truexyseries or its licensors and is protected by intellectual property laws.
Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes only.
Restrictions
You may not:
- Reproduce, distribute, or modify our content without permission
- Use our content for commercial purposes
- Remove or alter any copyright or proprietary notices
- Create derivative works based on our content
8. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Photographs and Videos
By using our facilities, you consent to being photographed or recorded for:

9. Termination
Termination by You
You may terminate your membership by providing 14 days written notice. Termination will be effective at the end of your current billing period.
Termination by Us
We may terminate your membership immediately if you:
- Violate these Terms or facility rules
- Engage in inappropriate or dangerous behavior
- Fail to pay required fees
- Provide false information during registration
Effect of Termination
Upon termination, you must immediately cease using our facilities and services. Any outstanding fees remain due and payable.
10. Dispute Resolution
Governing Law
These Terms are governed by New Zealand law, and any disputes will be subject to the exclusive jurisdiction of New Zealand courts.
Alternative Resolution
We encourage resolving disputes through direct communication. If needed, we may pursue mediation or other alternative dispute resolution methods before litigation.
11. General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Truexyseries regarding the use of our services.
Amendments
We may modify these Terms at any time. Material changes will be communicated through:

Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver
